A Biden Judge Just Released a Murder Suspect Who Snuck Into the Country Illegally — On ‘Minimal Conditions’

U.S. District Court Judge Melissa R. DuBose — a Biden appointee, naturally — just ordered the release of Bryan Rafael Gomez, an illegal immigrant who is wanted for homicide in the Dominican Republic. Gomez crossed the border illegally near Lukeville, Arizona back in 2022, got arrested in Worcester, Massachusetts for assault and battery on April 4th, and was released on a whopping $500 bail before ICE grabbed him with a detainer.

So a guy who snuck into this country illegally, who has an active murder warrant from the Dominican Republic, and who just got popped for beating someone up in Massachusetts… walked out of a federal courtroom on Tuesday under what the judge called “minimal release conditions.” Minimal! For a murder suspect! What are the conditions — a firm handshake and a promise to be a good boy?

Let’s walk through this, because the timeline is genuinely incredible.

Gomez illegally crosses the southern border in 2022. He doesn’t present himself at a port of entry. He doesn’t apply for asylum the legal way. He just waltzes in. Meanwhile, the Dominican Republic had already issued a homicide warrant for him back on January 24, 2023, out of the Coordination of the Courts of Instruction of the National District of Santo Domingo. That’s a real warrant, from a real court, for a real murder.

And this man was living freely in Massachusetts.

He finally gets arrested by the Worcester Police Department for assault and battery — because apparently fleeing a murder charge doesn’t exactly correlate with being a peaceful neighbor — and gets released on five hundred dollars bail. Five hundred bucks. Your average American pays more than that for a speeding ticket in some states.

ICE steps in and takes custody. This is exactly how the system is supposed to work. A dangerous illegal alien with a murder warrant gets picked up, detained, and processed for removal. End of story. Except Judge DuBose decided to insert herself into the process.

Gomez filed a habeas corpus petition — challenging his detention — and DuBose sided with the murder suspect over the federal agents trying to protect the public. She ordered him released on “minimal release conditions” this past Tuesday.

We’re going to need someone to explain what “minimal” means in the context of a guy wanted for killing someone in another country. An ankle bracelet? A curfew? A stern look? Because whatever it is, it’s not a jail cell, which is where a murder suspect who’s in this country illegally should be sitting.

Acting Assistant Homeland Security Secretary Lauren Bis nailed it when she called this “another example of an activist judge” undermining deportation efforts. That’s exactly what it is. This isn’t a judge interpreting the law. This is a judge making a political statement with someone else’s safety.

And here’s the part that should make your blood boil: this isn’t an isolated incident. Not even close.

Scott Mechkowski, who served as ICE’s deputy director, said this case is part of a broader pattern of foreign fugitives being released or cycling through arrest and re-arrest like it’s a revolving door. Catch, release, re-offend, catch again, release again. Rinse and repeat until somebody gets hurt — or worse.

Since President Trump’s second term began, over 18,000 habeas petitions have been filed challenging ICE detentions. Eighteen thousand. That’s more than the previous three administrations combined. The open-borders crowd figured out they can’t win at the ballot box, so they’re clogging the courts instead. And judges like DuBose are more than happy to play along.

Think about this from the perspective of someone living in Worcester, Massachusetts. There is now a man walking around your city — on “minimal conditions” — who is wanted for murder in another country, who broke into this country illegally, and who was just arrested for assaulting someone in your town. And a Biden-appointed judge decided that man should be free.

Do you feel safe? Does anyone in Worcester feel safe?

This is what Biden’s judicial appointments were designed to do. Not to uphold the law. Not to protect American citizens. But to serve as a backstop for the open-borders agenda long after Biden himself shuffled out of the White House. These judges are ticking time bombs planted throughout the federal judiciary, and they’re going off one by one.

President Trump’s team is fighting back — ICE is processing removals faster than any administration in history — but they’re doing it with one hand tied behind their back by activist judges who think a murder warrant from a foreign country is less important than an illegal immigrant’s feelings about being detained.

If Bryan Rafael Gomez so much as jaywalks while he’s out on Judge DuBose’s “minimal conditions,” that’s on her. Every single day he’s free instead of deported is a day she chose a political statement over public safety.

But sure — tell us again how the judiciary is an independent, nonpartisan institution. We’ll try to keep a straight face.
